1. Introduction and Acceptance
These Terms & Conditions (“Terms”) govern access to and use of the ChargeMe website, mobile applications, EV charging stations, charging-network services, digital charging-credit features, payment functions and related services (collectively, the “Services”). By accessing or using the Services, creating an account, adding charging credit, initiating a charging session or making a payment, the user agrees to these Terms and the policies incorporated by reference.
2. Service Provider and Applicable Market
For Bangladesh online merchant services, the merchant is ChargeMe OPC unless a checkout screen, quotation or contract expressly states otherwise. ChargeMe also develops services and partnerships in other markets, including Sri Lanka and Singapore. The applicable contracting entity, local requirements and service conditions may therefore differ by country.
3. User Eligibility and Account
Users must provide accurate and current information and must use the Services only for lawful purposes. Users are responsible for safeguarding account credentials, PINs, QR/RFID credentials and devices used to access ChargeMe. Activity carried out through a user account may be treated as authorized unless ChargeMe is promptly notified of suspected unauthorized access.
4. Charging Station Use
Users must follow on-screen instructions, site rules and safety notices; use only compatible vehicles and connectors; park responsibly; and avoid tampering with charging equipment, cables, software or electrical infrastructure. The user is responsible for confirming vehicle compatibility and safely connecting and disconnecting the vehicle.
5. Availability and Charging Performance
Station availability, charging power, charging speed and session duration may vary because of vehicle capability, battery state, temperature, grid conditions, site restrictions, network connectivity, maintenance, safety controls or other technical factors. A charger shown as available in the website or app is not a guarantee of uninterrupted availability.
6. Prices, Taxes and Fees
The applicable charging tariff, charging-credit amount, service fee and any applicable tax will be displayed through the relevant ChargeMe interface, quotation or checkout flow. Users should review the total payable amount before confirming payment.
7. Payments
Payments may be processed by authorized third-party payment gateways, banks, card networks, mobile financial services or other payment providers. ChargeMe does not require users to provide payment credentials outside the approved payment flow. A payment is treated as completed only after successful confirmation through the applicable payment system and ChargeMe’s transaction records.
8. Charging Credit / Prepaid Balance
Where available, users may add prepaid Charging Credit to their ChargeMe account for eligible charging services. Charging Credit is a service balance for ChargeMe charging use; it is not a bank deposit, savings account, investment product or interest-bearing balance. Promotional or bonus credit may be subject to separate validity and use conditions.
9. Charging Sessions and Billing
A charging session may be billed according to energy delivered, time, session fee or another tariff displayed for the relevant charger. ChargeMe may use charger meter values and system records to determine session consumption and charges. A user should report any apparent billing discrepancy promptly with the transaction/session reference.
10. Cancellation and Session Termination
A user may stop a charging session through the available charger/app controls where supported. Energy or service already delivered before termination remains chargeable. ChargeMe may stop or suspend a session for safety, insufficient authorized balance, technical faults, site requirements, regulatory requirements or misuse.
11. Refunds
Refunds, payment reversals, duplicate-payment handling and charging-credit adjustments are governed by the ChargeMe Return, Cancellation & Refund Policy published on the website.
12. Service Suspension and Maintenance
ChargeMe may temporarily suspend all or part of the Services for planned or emergency maintenance, software updates, cybersecurity, utility interruption, communication failure, safety reasons, legal/regulatory requirements or events beyond reasonable control.
13. Acceptable Use
Users must not misuse the Services, interfere with charger/network operation, attempt unauthorized access, reverse engineer protected systems where prohibited, manipulate payment or meter data, introduce malicious code, commit fraud, or use the Services in a way that could harm ChargeMe, a host site or another user.
14. Intellectual Property
ChargeMe names, logos, application interfaces, website content, software, graphics and other brand or technology materials are owned by or licensed to ChargeMe and may not be copied, reproduced or commercially used without authorization, except where applicable law permits.
15. Third-Party Services and Sites
The Services may rely on third-party payment, cloud, communications, mapping, charger, roaming or site-host systems. Those third parties may have separate terms and privacy practices. ChargeMe is not responsible for independent third-party services outside ChargeMe’s reasonable control, subject to rights that cannot be excluded by law.
16. Limitation of Liability
To the extent permitted by applicable law, ChargeMe will not be liable for indirect, incidental or consequential loss arising from vehicle incompatibility, user misuse, third-party service failure, utility outage, telecommunications failure or events beyond ChargeMe’s reasonable control. Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.
17. Privacy and Data Protection
ChargeMe processes personal information according to the Privacy Policy published on the website. Users should review that policy before creating an account or making a payment.
18. Changes to Terms
ChargeMe may revise these Terms to reflect changes in law, regulation, technology, payment arrangements or Services. The updated version will be published on the website with an updated effective date. Continued use after an update constitutes acceptance to the extent permitted by applicable law.
19. Governing Requirements and Disputes
Services are subject to the mandatory laws and consumer protections applicable in the jurisdiction where the relevant service is supplied. Users should first contact ChargeMe through the official support/contact channel so that a complaint or transaction dispute can be reviewed.
